A BILL to repeal section eight, article seven-b, chapter
fifty-five of the code of West Virginia, one thousand nine
hundred thirty-one, as amended, relating to limits on
liability for noneconomic loss.
Be it enacted by the Legislature of West Virginia:
ARTICLE 7B. MEDICAL PROFESSIONAL LIABILITY.
§1. Repeal of section relating to limits on liability for
noneconomic loss.
Section eight, article seven-b, chapter fifty-five of the
code of West Virginia, one thousand nine hundred thirty-one, as
amended, is hereby repealed.
NOTE: The purpose of this bill is to repeal §55-7B-8 which
sets a cap of $1,000,000 in damages recoverable for noneconomic loss in a medical professional liability action.
